HCL Tech Bypasses H1-B Visa Rules in US: Report

Noida-based IT services company HCL Technologies Ltd has bypassed H1-B visa rules in the United States, according to a report by the Economic Policy Institute (EPI).

HCL is the third-largest IT outsourcing company in India by revenue, generating over 60% of its $ 11 billion revenue in the United States.

“We estimate that HCL saves at least $ 95 million per year by illegally underpaying its H-1B employees. This represents $ 95 million in wages stolen from H-1B workers each year – a large-scale white-collar wage theft – which has been facilitated by negligent enforcement of labor standards in the H-1B program, ”says The report.

“Victims include not only H-1B workers, but also American workers who are either displaced or whose wages and working conditions deteriorate when employers are allowed to underpay skilled migrant workers with impunity.” , indicates the report.

EPI analysis of internal HCL document, released as part of whistleblower lawsuit against the company, says large-scale illegal underpayment of H-1B workers is a critical component of competitive strategy of the company.

The report further stated that “data from the company’s internal document suggests that the company is underpaying H-1B workers in virtually all jobs in all industries.”

A spokesperson for the company said in a statement, however, “HCL Technologies strictly complies with all applicable rules and regulations and is committed to paying salaries to all employees in accordance with applicable laws.”

Last year, HCL ranked eighth in total H-1B approvals with approximately 1,405 new visas and 2,801 visa renewals. Over the past twelve years, HCL has consistently been one of the largest H-1B employers, receiving a total of 31,000 H-1B visa approvals from USCIS since 2009, according to the report.

The H-1B visa program is the largest United States temporary work visa program for highly skilled workers, with approximately 600,000 visa holders currently in the United States. The H-1B visa allows companies to employ foreign workers with higher education qualifications under specific conditions.
